Split Sleeper Berth

An HOS provision that allows drivers to split their required 10-hour off-duty period into two separate rest periods using the sleeper berth.

The split sleeper berth provision is an Hours of Service flexibility rule that allows drivers to divide their required 10 consecutive hours of off-duty time into two separate periods, provided one of those periods is spent in the sleeper berth. Under the current regulations updated in 2020, drivers may split their rest using a 7/3 split, meaning one period of at least 7 consecutive hours in the sleeper berth and another period of at least 3 hours either in the sleeper berth or off duty.

When using the split sleeper berth provision, neither rest period counts against the driver's 14-hour driving window. The driver's available hours are calculated by combining the two rest periods, effectively pausing the 14-hour clock during each qualifying rest break. This provides significant operational flexibility, particularly for drivers dealing with loading delays or traffic congestion.

The split sleeper berth rule is one of the more complex aspects of HOS compliance and is a frequent source of confusion for both drivers and compliance managers. Proper use requires accurate ELD logging and a clear understanding of how the split periods interact with the 11-hour driving limit and the 14-hour on-duty window.
